Terms of Service

Stellenmedia (Pty) Ltd ("we", "us") operates the Seekulu mobile application ("App") and web portals at https://portal.seekulu.com (the "Service"). In these Terms, "Seekulu" means the Service and brand. By creating an account on the App and using the Service, Users agree to these Terms of Service ("Terms").

1. Who may use Seekulu

1.1. To use the App and Service the User acknowledge that they are:

1.1.1. are 18 years or older, or have a parent or guardian's consent where permitted by law;

1.1.2. have provided accurate registration information and agree to keep their account and login information secure; and

1.1.3. limited to one account per natural person. Users are strongly advised not to share their account credentials or impersonate others.

2. The Service

Seekulu is an outdoor lifestyle network for campers, hikers and other outdoor lifestyle enthusiasts ("Users") in Southern Africa. Users can explore places on a map, follow other users, post place-tagged trip content, write reviews, and save places and spots they have discovered. Business hosts ("Hosts") may also claim and manage listings through the host portal subject to separate business terms.

Core features such as the map, User's feed, posting, leaving reviews, following other users, searching and saving ("Features") are free to Users. Seekulu does not operate in-app retail checkout for gear or products. Contacting a host by phone or WhatsApp, or booking through third-party systems, is outside the purview of Seekulu and at the sole risk of the User unless and until in-app campsite booking is explicitly offered to participating Hosts.

3. User content

Users retain ownership of their content that they have uploaded, including photos, posts, reviews, comments, and profile information. Users expressly grant Seekulu a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute their content solely to operate and promote the Service, including thumbnails, feeds, and place pages.

By posting any of the above, the User represents that they have the right to post the content in question, that their content complies with Seekulu's Community Guidelines, and that place-tagged posts and reviews reflect genuine experiences where applicable. Seekulu reserves the right to remove content or suspend accounts that violate these Terms or any of our other policies where applicable.

4. Acceptable use

Users agree not to post spam, scams, harassment, hate speech, threats, illegal activity, explicit sexual content, gratuitous violence, fake or incentivised reviews, or business posts in the organic feed. Furthermore, Users also agree not to scrape, reverse-engineer, overload, circumvent authentication, bypass rate limits, or evade moderation. Please see the Community Guidelines for detail in this regard.

5. Moderation and termination

Seekulu retains the right to warn, suspend, or permanently ban Users, hide or remove content and report illegal activity to the relevant authorities where required by law. Seekulu maintains an audit trail of moderation actions taken against Users in this regard. Users may delete their account at any time using Settings → Delete account in the App, which permanently anonymises their personal data and removes their login. Users who manage a business listing should first email [email protected] so we can transfer or close the listing.

6. Disclaimers

The Service is provided to Users on the understanding that outdoor travel involves certain risks. Map pins, reviews, and other users posts are informational and should not be construed as professional, safety, legal, or medical advice. Users are strongly advised to always verify road conditions, access rules, and booking details with Hosts and other third party and official sources. Seekulu does not guarantee uninterrupted or error-free operation in this regard.

7. Limitation of liability

To the fullest extent permitted by South African law, the User fully indemnifies Stellenmedia (Pty) Ltd and its directors, employees, and suppliers against any indirect, incidental, or consequential damages they might suffer arising from or related to User's use of the Service or the App, including reliance on user-generated content or third-party contact details. Nothing in these Terms limits liability that cannot be excluded under the Consumer Protection Act or other mandatory legislation.

8. Governing law

These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of South African courts, unless mandatory consumer protection rules provide otherwise.

9. Changes

Seekulu reserves the right to update these Terms from time to time as needed. When the Terms have been updated, we will post it on the App under the following menu: /legal/tos with an updated version date. Users will be prompted to review and accept the updated policies in the app before continuing to use Seekulu. If the User does not accept the updated terms, they will be unable to use the Service and App any further and may delete their account at any time using Settings → Delete account.
